DMCA Takedown Policy

Hookspotter respects the rights of copyright holders. If you believe content on the service infringes your copyright, send a notice that meets the requirements of 17 U.S.C. § 512(c)(3) to the designated agent below.

What your notice must include

  1. An electronic or physical signature of the copyright owner (or their agent).
  2. A description of the copyrighted work you believe is infringed.
  3. A description of where the infringing material is located on the service (URL, song id, etc.) — enough that we can find it.
  4. Your address, phone number, and email.
  5. A statement, made in good faith, that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on its behalf.

Counter-notification

If you believe content of yours was removed in error, you may submit a counter-notification under 17 U.S.C. § 512(g)(3). It must include:

  1. Your physical or electronic signature.
  2. The material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, phone number, and a statement consenting to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the US, the Western District of Pennsylvania).

Repeat infringers

We will terminate accounts of users who are determined to be repeat infringers in appropriate circumstances.

What we will NOT do

Filing a fraudulent DMCA notice exposes you to liability for damages under 17 U.S.C. § 512(f). We will reject notices that are obviously not made in good faith.
